The UK's leading Medical Defence Union (MDU) has warned its doctor members that the recent decision by the Director of Public Prosecutions regarding the parents of Daniel James does not change the legal position of doctors regarding physician assisted suicide.
Experts for the MDU warned doctors:
In our view, the decision in relation to Daniel James is case-specific and while it may have some relevance for parents or very close relatives, this is not to say it will apply to others, including our members involved in caring for a patient. While suicide is no longer an offence, it remains an offence in England and Wales to assist the suicide of another and, even if there were no criminal proceedings, the GMC may still decide to investigate the doctor's fitness to practise.
